Terms of Service

01. Acceptance of Terms
By creating an account, accessing, or using CardMotion ("the Platform," "we," "us," or "our"), you ("Merchant," "Seller," or "you") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately cease using the Platform. We reserve the right to modify these Terms at any time; continued use of the Platform constitutes acceptance of any changes.
02. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use CardMotion. By using the Platform, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into a binding agreement.
03. Account Responsibilities
You are solely responsible for maintaining the confidentiality of your account credentials, including your password and Litecoin wallet address. You agree to:
- Provide accurate and truthful information when creating your account.
- Not share your login credentials with any third party.
- Immediately notify us of any unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
04. Prohibited Content & Activities
You agree not to use CardMotion to sell, distribute, promote, or facilitate the sale of any of the following. Violation of this section will result in immediate account termination and permanent freezing of all associated funds:
Any sexually explicit material, adult entertainment, escort services, or NSFW content of any kind.
Controlled substances, narcotics, counterfeit goods, stolen property, weapons, explosives, hacking tools or services, personal data obtained without consent, or any product or service that violates applicable law in any jurisdiction.
Reselling, sublicensing, white-labeling, or repackaging CardMotion's payment processing services to third parties. You may not use CardMotion as a payment backend for your own payment platform or facilitate payment processing on behalf of others.
Pyramid schemes, Ponzi schemes, multi-level marketing, fraudulent chargebacks, money laundering, terrorist financing, or any deceptive business practice.
Online gambling, lotteries, fantasy sports with monetary stakes, or any activity requiring specific licensing or regulatory approval that you do not hold.
This list is non-exhaustive. CardMotion reserves the right to determine, at its sole discretion, whether any content or activity violates these Terms.
05. Fund Freezing & Enforcement
CardMotion reserves the right to immediately freeze, withhold, or permanently seize any and all funds held in your account (including pending payouts, processing balances, and held balances) if we determine, at our sole discretion, that you have violated these Terms of Service.
In the event of a Terms violation, we may, without prior notice:
- Immediately suspend or terminate your account.
- Freeze all pending, processing, and awaiting-payout balances indefinitely.
- Withhold funds to cover potential chargebacks, refunds, fines, or liabilities.
- Report activity to relevant law enforcement or regulatory authorities.
- Refuse future service to you and any associated accounts.
Frozen funds may be held for up to 180 days or longer if required for dispute resolution, investigation, or compliance with legal obligations. CardMotion is not obligated to return any funds associated with accounts that have violated these Terms.
06. Payments, Fees & Payouts
CardMotion charges a platform fee on each transaction, the rate of which is determined by your subscription tier. Fees are non-refundable. Payouts are processed in Litecoin (LTC) on a weekly basis to the wallet address you have configured in your account settings. You are responsible for ensuring your wallet address is correct; CardMotion is not liable for funds sent to an incorrect address provided by you.
CardMotion reserves the right to modify fee structures with reasonable notice. You may hold a processing period on transactions for fraud prevention, during which funds are held before being moved to your pending payout balance.
07. Refunds & Disputes
As a Merchant, you are responsible for fulfilling your obligations to buyers, including delivering the advertised digital goods or services. CardMotion may process refunds or chargebacks at the request of buyers or payment processors. In the event of a chargeback or dispute:
- The disputed amount will be deducted from your balance.
- Additional chargeback fees imposed by payment processors may be passed on to you.
- Excessive chargebacks may result in account suspension or termination.
08. Intellectual Property
All CardMotion branding, software, design elements, and proprietary technology are the exclusive property of CardMotion. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the Platform without prior written consent. You retain ownership of the digital products you sell through the Platform and are solely responsible for ensuring you have the right to sell them.
09. Limitation of Liability
CardMotion is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, CardMotion disclaims all warranties, express or implied, and shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform. Our total liability shall not exceed the amount of fees you have paid to CardMotion in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless CardMotion, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or any content or products you sell through the Platform.
11. Privacy
CardMotion collects and processes data necessary to operate the Platform, including email addresses, IP addresses, transaction data, and wallet addresses. We do not sell your personal data to third parties. Transaction data may be shared with payment processors as required to facilitate payments. By using the Platform, you consent to such data collection and processing.
12. Termination
Either party may terminate this agreement at any time. You may close your account by contacting support. CardMotion may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, any outstanding balance may be subject to a holding period for chargeback protection before being released. Accounts terminated for Terms violations may have their funds permanently frozen as described in Section 5.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration.
